Liubou Kavaliova: Decision of the Human Rights Committee of the UN concerning the violations in the case of my son must become a reference book for all judges

March 12, mother of Uladzislau Kavaliou, executed by shooting on the verdict of teh Supreme Court, paid a visit to the Chairman of the Vitsebsk Regional Court Mikalai Khamichenka Hamichenka. He did not allow her to distribute brochures with the decision of the UN HRC decision and threatened that such actions would be regarded as illegal picketing.

According to Liubou Kavaliova, all violations, recognized by the UN HRC in the case concerning allegations of organizing the explosion in the Minsk subway on April 11, 2011, should be analyzed by the judges who make hard sentences, including the death penalty:

"Judges must remember that they decide people's lives and understand their responsibility for it, to prevent violations similar to that found by the UN HRC in Uladzislau's casea. Such violations were also discovered during the investigation of this case and during the trial, and after it, when my son was shot, the address of the HRC to postpone the execution of the sentence so that it could clarify all the circumstances ... I brought 25 brochures with the decision of the UN HRC to the Vitsebsk Regional Court to pass them personally to each judge. Chairman of the court didn't let me do it, and also responded to my proposal to hand out the brochures at the entrance of the court that it would be regarded as unauthorized picket.”

Human rights defender Pavel Levinau, present at the meeting of the convict's mother with the official, tried to get an explanation why the brochures could not be passed to the judges:

"Chairman of the court stated that these were valuables, and their distribution could be considered as bribery! However, he took a brochure and promised to familiarize all judges with its content.
What concerns the proposal to distribute the brochures outside the building, Mr. Khamichonak stated that it would be picketing with “political aims”. However, he was unable to explain what these political ams were."

Liubou Kavaliova also sent the same brochures to all regional courts of Belarus, as well as to prosecutors of all levels.

In addition, the mother and sister of
Uladzislau Kavaliou applied to the Prosecutor General
Aliasandr Kaniuk. They demand that the prosecutor's office resume the investigation into the Case due to new circumstances for the purpose of posthumous rehabilitation of Mr. Kavaliou.

In October 2011, Uladzislau Kavaliou and Dzmitry Kanavalau were sentenced to death on charges of organizing and perpetrating a
terrorist attack in Minsk subway on April 11, 2010. In March 2012, both were executed. The official date of execution is March 15, 2012, although the relatives have reasons to believe that the real date is March 11. Since then, Uladzislau Kavaliou's mother has been struggling for receiving the son's body and being informed about the exact date of the execution. She refers to the decision of the Human Rights Committee of the UN, according to which concealment of the burial place of death convicts is regarded as torture.

Liubou Kavaliova doesn't believe her son is guilty, says that the criminal charges on the case are false, the trial was unfair and the verdict was illegal. Her position is shared by many people in Belarus and abroad.
