Examination of Criminal Procedure Code at request of Kavalyow`s mother is advisable, says Presidential Administration
The Presidential Administration has replied to an application from the mother of Uladzislaw Kavalyow, who was sentenced to death in the subway bombing case last year, saying that it is advisable examine the country’s Criminal Procedure Code at her request.
Lyobow Kavalyow received the reply from the Presidential Administration’s migration and clemency department on February 18, Brest-based human rights defender Raman Kislyak, who consults the woman on legal matters, told BelaPAN.
It reads that “a comprehensible legal analysis of regulations involving concerned governmental agencies is advisable.”
On February 1, Ms. Kavalyow, who earlier complained together with her daughter to the UN Human Rights Committee about the death sentence on the young man, asked the Constitutional Court to examine whether national regulations should allow the execution of death row inmates before the consideration of their appeals by international institutions.
The Court replied that it may not consider petitions filed by individuals.
On February 6, Ms. Kavalyow petitioned Alyaksandr Lukashenka, the Council of Ministers, both parliamentary chambers and the Supreme Court to ask the Constitution Court to examine the constitutionality of the Criminal Procedure Code.
Mr. Kavalyow, 26, was sentenced with his friend Dzmitry Kanavalaw to death on November 30, 2011. They were convicted of the two 2005 bomb explosions in Vitsyebsk, the bomb attack that occurred during an open-air Independence Day concert in Minsk in July 2008 and the April 11, 2011 subway bombing that killed 15 people and injured more than 200. Mr. Kanavalaw was found guilty of perpetrating them, while Mr. Kavalyow of acting as his accomplice, as well as of failure to report the crimes or their preparation.
